Welcome to AbleVu.

These Terms and Conditions explain the rules that apply when you access or use AbleVu.com, AbleBot, accessibility profiles, business listings, contributor tools, forms, newsletters, scheduling links, payment features, partner resources, and any other websites, products, services, or tools offered by AbleVu.

By using AbleVu, creating an account, submitting information, purchasing a product or service, participating in a program, or interacting with AbleBot, you agree to these Terms. If you do not agree, please do not use AbleVu.

1. Who We Are

AbleVu helps people, families, caregivers, businesses, destinations, governments, organizations, and communities find, collect, share, and understand practical accessibility information.

2. Who These Terms Apply To

These Terms apply to all users of AbleVu, including:

  • Website visitors
  • Travelers, families, caregivers, and individuals searching for accessibility information
  • People who create AbleVu profiles or user accounts
  • Businesses, venues, attractions, hotels, restaurants, event spaces, and other locations
  • Destination marketing organizations, tourism offices, governments, chambers, economic development organizations, and community partners
  • Contributors, applicants, students, schools, workforce programs, nonprofits, athletic teams, and community organizations
  • Newsletter subscribers
  • Customers who purchase AbleVu products or services
  • Partners, sponsors, investors, and prospective partners
  • Anyone who submits, edits, views, or relies on information through AbleVu

Some products, services, partnerships, subscriptions, contributor programs, or paid projects may also have separate agreements, order forms, statements of work, payment terms, contributor agreements, school agreements, or partner terms. If there is a conflict between these Terms and a signed agreement with AbleVu, the signed agreement will control for that specific relationship.

3. AbleVu Is an Information Platform

AbleVu provides accessibility information, business profile tools, AI-powered search features, contributor-supported data collection, and related resources.

AbleVu does not guarantee that any location, business, venue, destination, event, website, product, service, or experience will meet every person’s needs.

Accessibility is personal. A location may work well for one person and not work for another. Information on AbleVu is intended to help people make more informed decisions, but it should not be treated as a guarantee.

Users should confirm important details directly with a business, venue, destination, transportation provider, event organizer, hotel, restaurant, attraction, medical provider, or other relevant party before making decisions.

4. No Certification or Legal Compliance Guarantee

An AbleVu profile, listing, badge, page, data point, search result, or AbleBot response does not mean that a business, location, destination, event, or organization is legally compliant with the Americans with Disabilities Act, local accessibility laws, building codes, civil rights laws, employment laws, education laws, travel laws, transportation rules, website accessibility standards, or any other legal requirement.

AbleVu does not provide legal certification, architectural certification, medical clearance, safety certification, building inspection approval, or government approval unless expressly stated in a separate signed agreement.

Businesses, destinations, governments, and organizations are responsible for understanding and complying with laws that apply to them.

5. AbleBot and AI Features

AbleVu may offer AI-powered tools, including AbleBot, to help users search for, understand, and interact with accessibility information.

AbleBot may use information from AbleVu profiles, public sources, business submissions, contributor submissions, user preferences, or other available data to provide responses.

AbleBot is designed to be helpful, but AI-generated responses may be incomplete, outdated, inaccurate, or not appropriate for every situation.

You agree that:

  • AbleBot is not a substitute for professional advice.
  • AbleBot should not be used for emergencies.
  • AbleBot should not be relied on as the only source for critical access, safety, medical, legal, travel, or transportation decisions.
  • You are responsible for confirming important details directly with the relevant business, venue, destination, or service provider.
  • You should not submit confidential, emergency, financial, medical record, government identification, or highly sensitive information into AbleBot.

AbleVu may monitor, review, store, or use AbleBot interactions to operate, improve, test, and protect the service, subject to our Privacy Policy.

6. Accessibility Information and Data Accuracy

AbleVu works to provide clear, practical accessibility information. Information may come from:

  • Businesses or location owners
  • Contributors
  • Users
  • Destination partners
  • Publicly available sources
  • Third-party tools or services
  • AbleVu team members
  • AI-assisted data processing
  • Updates submitted through AbleVu tools

Although we work to review and improve information, AbleVu does not guarantee that all information is complete, current, accurate, or suitable for your specific needs.

Accessibility details may change because of renovations, staffing, weather, events, temporary closures, construction, policy changes, ownership changes, equipment issues, or other circumstances outside AbleVu’s control.

Businesses and partners are responsible for keeping their own information accurate and updated.

7. User Profiles and Personal Preferences

AbleVu may allow users to create profiles or share preferences related to mobility, sensory needs, communication, allergies, medical considerations, hearing, vision, stamina, body size, aging-related needs, cognitive needs, or other access needs.

You are responsible for the information you choose to share.

You should only share information that you are comfortable providing. AbleVu uses this information to help personalize and improve the user experience, subject to our Privacy Policy.

AbleVu does not provide medical advice, diagnosis, treatment, safety advice, travel agent services, legal advice, or emergency services.

8. Business Profiles and Location Listings

Businesses, venues, attractions, hotels, restaurants, destinations, events, public spaces, and other organizations may have profiles or listings on AbleVu.

Business profile information may include accessibility features, photos, descriptions, contact information, website links, amenities, categories, location details, user-facing information, and other content.

If you submit or manage a business profile, you agree that:

  • You have the authority to submit or update the information.
  • The information you provide is accurate to the best of your knowledge.
  • You will not misrepresent accessibility features, services, ownership, qualifications, or affiliations.
  • You will not claim certifications, badges, endorsements, ratings, or legal compliance unless they are accurate and authorized.
  • You will promptly update information if you learn it is incorrect or outdated.
  • You have the rights or permission to submit photos, logos, descriptions, videos, documents, or other materials.
  • Your submitted content does not violate another person’s rights.

AbleVu may review, edit, reject, remove, label, or update business profile information at its discretion.

9. Paid Products, Subscriptions, and Services

AbleVu may offer free and paid products or services, including business profiles, subscriptions, destination packages, partner programs, setup services, contributor-supported data collection, training, sponsorships, advertising, featured placements, software tools, AI features, or other offerings.

Pricing, scope, deliverables, renewal terms, payment deadlines, cancellation terms, and refund terms may be provided on the website, in an order form, invoice, proposal, statement of work, checkout page, or separate written agreement.

Unless otherwise stated in writing:

  • Fees are due according to the checkout page, invoice, or agreement.
  • Taxes, payment processing fees, or other charges may apply.
  • Paid services do not guarantee traffic, sales, bookings, rankings, leads, revenue, government approval, legal compliance, or accessibility outcomes.
  • AbleVu may suspend or remove paid features for non-payment, misuse, inaccurate information, or violation of these Terms.
  • Subscription features may renew unless canceled according to the applicable subscription terms.
  • Refunds are not guaranteed unless required by law or stated in a separate written agreement.

10. Destination, Government, and Partner Programs

AbleVu may work with destinations, governments, tourism offices, chambers, economic development organizations, event organizers, universities, schools, nonprofits, sponsors, and other partners.

Partner programs may include accessibility data collection, city or destination pages, community profiles, Contributor Program support, marketing, training, sponsorships, AI tools, business outreach, reports, or other services.

Unless otherwise stated in a signed agreement:

  • AbleVu does not guarantee participation from any specific number of businesses.
  • AbleVu does not guarantee visitor traffic, rankings, revenue, bookings, event attendance, or press coverage.
  • AbleVu does not guarantee that a destination or business will meet any legal accessibility standard.
  • Partner organizations are responsible for their own public claims, marketing statements, government requirements, procurement rules, and legal obligations.
  • AbleVu may identify partners publicly unless a separate written agreement says otherwise.

11. Contributor Program

AbleVu may offer Contributor Program opportunities for individuals, students, schools, nonprofits, workforce programs, athletic teams, community organizations, people with disabilities, or other participants.

Contributors may help collect accessibility information, visit locations, submit data, support business profiles, complete assignments, or participate in training.

Participation in the Contributor Program may be subject to separate contributor terms, school agreements, program rules, payment requirements, safety rules, parental or guardian consent, approval standards, and project-specific instructions.

Unless a separate written agreement says otherwise:

  • Applying does not guarantee acceptance.
  • Participation does not guarantee assignments, income, payment, employment, or future work.
  • Contributors are responsible for following laws, safety rules, site rules, school rules, and AbleVu instructions.
  • Contributors must submit honest and accurate information.
  • Contributors must not trespass, misrepresent themselves, harass businesses, disrupt operations, or collect information in unsafe ways.
  • Contributors must respect privacy and may not photograph or record people without permission where permission is required.
  • Payments, if any, are subject to approval, completion requirements, verification, tax documentation, and applicable program terms.
  • Participation does not create an employment relationship unless a separate written agreement expressly says it does.

12. User Content and Submitted Materials

You may be able to submit content to AbleVu, including text, photos, videos, profile details, accessibility observations, business updates, reviews, feedback, forms, messages, documents, or other materials.

You keep ownership of content you submit, but you grant AbleVu a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, host, store, copy, display, publish, edit, translate, adapt, distribute, create derivative works from, and otherwise use that content to operate, improve, market, and provide AbleVu services.

You represent that:

  • You have the right to submit the content.
  • The content is accurate to the best of your knowledge.
  • The content does not violate another person’s rights.
  • The content does not contain unlawful, harmful, misleading, discriminatory, defamatory, abusive, private, confidential, or infringing material.
  • The content does not include false claims, fake reviews, deceptive testimonials, or undisclosed paid endorsements.

AbleVu may remove or edit submitted content at any time.

13. Reviews, Testimonials, Endorsements, and Marketing Content

If AbleVu allows reviews, testimonials, ratings, success stories, endorsements, influencer content, partner quotes, or user feedback, all such content must be truthful and based on real experiences.

You may not submit fake reviews, paid reviews without proper disclosure, AI-generated fake testimonials, misleading endorsements, false claims, or content that misrepresents your relationship with AbleVu or another business.

AbleVu may remove, label, reject, or moderate reviews, testimonials, or endorsements that appear misleading, false, abusive, irrelevant, or inconsistent with our policies.

14. Acceptable Use

You agree not to use AbleVu to:

  • Violate any law or regulation
  • Submit false, misleading, harmful, or inaccurate information
  • Impersonate another person, business, government agency, organization, or AbleVu representative
  • Misrepresent accessibility features, credentials, qualifications, endorsements, or affiliations
  • Harass, threaten, abuse, discriminate against, or harm others
  • Upload viruses, malware, spyware, or harmful code
  • Attempt to hack, scrape, overload, reverse engineer, or disrupt AbleVu systems
  • Bypass security, authentication, payment, or access controls
  • Use AbleBot or the website to generate harmful, illegal, deceptive, or abusive content
  • Collect personal information from others without authorization
  • Use AbleVu content to build a competing database, directory, AI model, scraping system, or commercial product without written permission
  • Copy, reproduce, sell, or exploit AbleVu content except as allowed by these Terms
  • Use the service in a way that interferes with other users or AbleVu operations

AbleVu may suspend or terminate access for violations of these Terms.

15. Accounts and Security

Some AbleVu features may require an account.

You are responsible for:

  • Providing accurate account information
  • Keeping your login credentials secure
  • All activity under your account
  • Notifying AbleVu if you suspect unauthorized access

AbleVu may suspend, limit, or terminate accounts that appear fraudulent, inactive, harmful, inaccurate, or in violation of these Terms.

16. Intellectual Property

AbleVu owns or licenses the AbleVu name, logo, branding, website design, software, platform features, AbleBot, content, data structures, profile formats, page layouts, badges, icons, processes, documentation, marketing materials, and other intellectual property.

You may not copy, modify, distribute, sell, reproduce, reverse engineer, or create derivative works from AbleVu intellectual property without written permission.

You may link to AbleVu pages in a fair and lawful way, as long as the link does not misrepresent your relationship with AbleVu or imply unauthorized endorsement.

17. Third-Party Services and Links

AbleVu may link to or integrate third-party services, including maps, payment processors, analytics tools, scheduling tools, email platforms, HubSpot, social media platforms, video tools, plugins, business websites, partner websites, and other services.

Third-party services are governed by their own terms and privacy policies. AbleVu is not responsible for third-party websites, tools, content, policies, availability, accessibility, security, or accuracy.

18. Privacy

AbleVu’s collection and use of personal information is described in our Privacy Policy.

By using AbleVu, you agree that we may collect, use, and share information as described in the Privacy Policy.

19. Accessibility Feedback

AbleVu is committed to improving accessibility and usability.

20. No Professional Advice

AbleVu provides information and technology tools. AbleVu does not provide medical advice, legal advice, architectural advice, engineering advice, financial advice, emergency advice, travel agent services, or safety certification.

Information on AbleVu should not replace professional advice or direct confirmation with a business, venue, destination, service provider, government agency, medical provider, or qualified professional.

21. Service Changes and Availability

AbleVu may change, update, suspend, remove, or discontinue any part of the website, AbleBot, profiles, content, subscriptions, programs, pricing, or services at any time.

We may also perform maintenance, testing, improvements, or security updates that temporarily affect availability.

AbleVu does not guarantee that the website or services will always be available, uninterrupted, error-free, secure, or current.

22. Termination

AbleVu may suspend or terminate your access to the website, account, program, tools, or services if we believe you have violated these Terms, created risk, failed to pay required fees, submitted inaccurate information, misused the platform, or acted in a way that harms AbleVu, users, businesses, partners, contributors, or the public.

You may stop using AbleVu at any time.

Termination does not eliminate obligations that should reasonably continue, including payment obligations, content licenses, disclaimers, limitations of liability, indemnity, and dispute provisions.

23. Disclaimers

AbleVu is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, AbleVu disclaims all warranties, express or implied, including warranties of accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, non-infringement, and suitability for any specific accessibility need.

AbleVu does not guarantee that:

  • Any information will be complete, accurate, current, or useful for every person
  • Any location will meet your specific accessibility needs
  • Any business or destination will be legally compliant
  • AbleBot responses will be accurate or complete
  • Paid services will produce any particular result
  • Contributors will receive any specific number of assignments or payments
  • Businesses will receive any specific number of views, leads, visits, customers, bookings, or revenue
  • The website or services will be uninterrupted or error-free

Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.

24. Limitation of Liability

To the fullest extent permitted by law, AbleVu and its owners, officers, directors, employees, contractors, contributors, partners, service providers, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages arising from or related to your use of AbleVu.

This includes damages related to:

  • Reliance on accessibility information
  • AbleBot responses
  • Business profile information
  • User-submitted content
  • Contributor-submitted information
  • Third-party services
  • Travel, event, venue, lodging, dining, transportation, or accessibility decisions
  • Service interruptions
  • Data loss
  • Unauthorized access
  • Missed opportunities, lost revenue, or reputational harm

To the fullest extent permitted by law, AbleVu’s total liability for any claim related to the website or services will not exceed the amount you paid to AbleVu for the specific service giving rise to the claim during the six months before the claim arose, or one hundred dollars if you did not pay AbleVu for that service.

Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.

25. Indemnification

You agree to defend, indemnify, and hold harmless AbleVu and its owners, officers, directors, employees, contractors, contributors, partners, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

  • Your use of AbleVu
  • Your violation of these Terms
  • Your submitted content
  • Your business profile information
  • Your violation of another person’s rights
  • Your violation of law
  • Your misuse of AbleBot or AbleVu data
  • Your participation in a Contributor Program, partner program, or business program

26. International Users

AbleVu is based in the United States. If you access AbleVu from outside the United States, you are responsible for complying with local laws that apply to you.

AbleVu makes no promise that the website, services, content, products, or programs are appropriate or available in every country.

27. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles, unless a separate signed agreement states otherwise.

If another jurisdiction’s laws require different rights or procedures, those rights will apply only to the extent required by law.

28. Dispute Resolution

Before filing a legal claim, you agree to contact AbleVu at support@ablevu.com and give us a reasonable opportunity to resolve the issue informally.

If a dispute cannot be resolved informally, the dispute will be handled in the state or federal courts located in Texas, unless a separate signed agreement or applicable law requires a different forum.

You and AbleVu agree to bring claims only on an individual basis and not as part of a class action, collective action, or representative action, to the extent permitted by law.

29. Changes to These Terms

AbleVu may update these Terms from time to time.

When we update them, we will change the "Last updated" date at the top of this page. If changes are significant, we may provide additional notice.

Your continued use of AbleVu after updated Terms are posted means you accept the updated Terms.
